In Utah, variances are defined in State Code under §10-9a-702 for municipalities and §17-27a-702 for counties.
As it pertains to land use, a “variance” is the process used when any person or entity, desiring a waiver or modification of the requirements of a land use ordinance as applied to parcel of property that they own, lease, or in which they hold some other beneficial interest, applies to the applicable appeal authority for a variance (i.e. modification) from the terms of the ordinance.
