Enacted by H.B. 288 in the 2019 General Session, §10-9a-9, Vested Critical Infrastructure Materials Operations, contains:

  • Provisions related to vested critical infrastructure materials operations;
  • Provides for the creation of critical infrastructure materials protection areas; and
  • Limits local regulation of critical infrastructure materials protection areas.

Critical infrastructure materials operations are defined in §10-9a-901 of Utah State Code (as amended) as: the extraction, excavation, processing, or reprocessing of critical infrastructure materials.  

What are considered critical infrastructure materials you might ask? In Utah, they are specifically defined as sand, gravel, or rock aggregate. (Hint: You may want to remember that for the test at the end of this module).Special Note: The Office of the Property Rights Ombudsman has provided funding for this training program from the 1% surcharge on all building permits in the State of Utah.
